Protecting the security and privacy of personal information is critical to us.  This Privacy Notice describes privacy practices for the services Volkswagen Group of America, its authorized Outside Contractors, or a designated settlement or claims administrator (collectively, “VWGoA”, “we” or “us”) make available through this website located at (the “Settlement Website”). 

    The Settlement Website has been established to provide information about, and to receive and process claims for, the Settlement.  This Privacy Notice applies to information that you submit through the Settlement Website. The information that we collect will be used solely for the purpose of the Settlement and the claims administration process, as governed by the Court.

    We reserve the right to change this Privacy Notice, so long as the change is consistent with the Settlement Agreement.  We recommend that you review this Privacy Notice regularly to ensure that you are familiar with our privacy practices.  If at any time you have questions regarding this Privacy Notice, you may contact us at the email or postal address listed in the last paragraph of this Privacy Notice.

  3. Policies Concerning PII Collected by VWGoA

This Privacy Notice is designed to prevent the unauthorized disclosure of non-public personally identifiable information that may either identify an individual or may be used together with other information to do so (“PII”) in the possession of VWGoA.  Pursuant to court-ordered procedures, VWGoA may collect PII directly through this Settlement Website or through proof of claims forms which it disseminates.

To participate in the Settlement, you may be required to provide PII in order to access the Settlement Website and the information available through it.  To do so, you may need to provide us with your name, email address, mailing address, zip code, and other personal information.  You may also be asked to provide financial or other PII that we need in order to evaluate, process and pay your proof of claim. 

      3. Children’s Privacy
        Protecting the privacy of the very young is especially important.  For that reason, VWGoA never collects or maintains information at the Settlement Website from those we actually know are under age 13, and no part of the Settlement Website is designed or intended to attract anyone under age 13.

      4. How We May Use PII
        VWGoA will retain and use PII to accomplish the purposes relevant to processing a proof of claim related to the Settlement or Settlement proceedings.   We will retain such PII only so long as is necessary to accomplish this purpose, to comply with orders of the court, and to comply with applicable laws, regulations, and VWGoA policies.  All hard copy and electronically stored PII shall be destroyed in compliance with court orders and VWGoA’s document retention policies, as applicable.  PII will be destroyed in a manner that prevents loss, theft, misuse or unauthorized access.

      5. When VWGoA May Disclose PII
        We will only use or disclose your information in accordance with this Privacy Notice or as authorized by you. We may use your information to administer the Settlement which includes:

        • Responding to your inquiries, directions and requests regarding the Settlement
        • Processing and administration of claims and payments (e.g. to send you amounts due under the Settlement)
        • Effectuating the Settlement (including using your PII in accordance with the Settlement)
        • Improving our Settlement administration services

        We may also use your information to communicate with you about the status of the Settlement and matters relating to the Settlement.

        We will not associate PII collected from you through the Settlement Website with any of your PII that we obtain from sources other than you or other than through the Settlement Website except for the uses specified by this Privacy Notice, unless such information is public or as authorized by you.

        Except as provided in this Privacy Notice or as authorized by you, we will not share any of your PII with any other person.  We may disclose information that you provide about your Claim so long as we do not disclose your PII.  In addition, we may share information from you and others in aggregated, non-personally identifiable form with any other person, including members of the general public.

        We may also use information, or share information with third parties, when we have a good faith belief that access, use, preservation or disclosure of the information is reasonably necessary to (a) comply with legal process or otherwise satisfy any applicable law or regulation; (b) prevent fraud or imminent harm; (b) ensure the security of information; or (d) address technical issues.

        We may use independent contractors, vendors, and suppliers ("Outside Contractors"). If we use Outside Contractors to assist with the processing of your information, we may disclose your information to them or receive your information through them. Before disclosing any information to an Outside Contractor, we will, at a minimum, require that it agrees to comply with our obligations under this Privacy Notice with respect to information it receives from us or from you as our Outside Contractor.

      6. Cookies and Similar Technologies
        When you visit the Settlement Website, we use various technologies to collect and store information, and this may include using cookies or pixel tags to identify your browser or device. 

        A cookie is a small file containing a string of characters sent to your computer.  We use cookies for various reasons which include enabling us to recognize when you log in to the Settlement Website, to provide access to your account while you are logged in, to store your language preferences and to facilitate your use of the Settlement Website.  Pixel tags are small graphic files that allow us to monitor the use of the Settlement Website. A pixel tag can collect information such as the Internet Protocol address of the computer that downloaded the page on which the tag appears; the URL of the page on which the pixel tag appears; the time the page containing the pixel tag was viewed; the type of browser that that fetched the pixel tag; and the identification number of any cookies on the computer previously placed by that server.  When corresponding with you via HTML capable email, we may use "format sensing" technology, which allows pixel tags to let us know whether you received and opened our email. 

      7. Access to and Removal of Information
        You may request that we correct inaccurate PII or delete your PII stored by us in electronic form. We will honor your request but we are unable to guarantee that all such information will be deleted because some residual information may remain on back-up storage and other media. Please note that deletion of some or all of your PII may affect your ability to participate in the Settlement.

      8. Security
        VWGoA personnel and its authorized Outside Contractors or designated settlement or claims administrator are required to follow specific security procedures for storing, using, and disposing of PII provided to VWGoA.  VWGoA may grant access to such PII only to individuals who reasonably need access to accomplish the purposes for which VWGoA collected the PII.  VWGoA policy prohibits the unlawful disclosure of PII. VWGoA considers all such information to be Confidential Information that may be used only for the purposes for which it was provided to VWGoA and for any other settlements or proceedings to which the information may be relevant, and may not be disclosed or disseminated unless there is a business need to do so.

        When you input information on our Settlement Website, all of your information is transmitted through the Internet using Secure Sockets Layer (SSL) technology. SSL technology causes your browser to encrypt your information before transmitting it to our secure server. SSL technology, an industry standard, is designed to prevent someone other than operators of the Settlement Website from capturing and viewing your personal information.

        While we use industry standard means to protect the Settlement Website and your information, the Internet is not 100% secure. The measures we use are appropriate for the type of information we collect. We cannot promise that your use of the Settlement Website will be completely safe. We encourage you to use caution when using the Internet.

      9. Links
        The Settlement Website may contain links to third party websites.  If you click on one of those links, you will be taken to websites we do not control.  This Privacy Notice does not apply to the information collection practices of those websites.  You should read the privacy policies on other websites carefully.  We are not responsible for third party websites.

      11. Disclaimer
        The Settlement Website is not operated by Volkswagen Group of America. This Settlement is supervised by the Court and is administered by a claims administration firm that handles all aspects of claims processing.
